By accessing or browsing this website, creating an account, or placing an order with Noirva, you agree to these Terms and Conditions and any other policies referenced on the Site.

Noirva may update these Terms and Conditions from time to time. Unless otherwise required by applicable law, changes become effective when posted on the Site. Your continued use of the Site following an update constitutes acceptance of the revised terms.

If you do not agree with these Terms and Conditions, please discontinue use of the Site.

Intellectual Property

Unless otherwise stated, all content on noirva.com, including text, imagery, graphics, product designs, branding, logos, layouts, and other materials, is owned by or licensed to Noirva and is protected by applicable intellectual property laws.

You may view, download, or print content from the Site for personal, non-commercial use only.

You may not, without prior written permission from Noirva:

• Republish or redistribute material from the Site.

• Sell, rent, license, or sublicense Site content.

• Reproduce, duplicate, modify, or commercially exploit Site content.

• Use Noirva imagery, designs, branding, or other protected materials for commercial purposes.

Product Availability

Every Noirva piece is made to order. Availability therefore depends on the gemstones, metals, components, and production capacity required for each individual piece rather than conventional finished-product inventory.

Although we make every effort to keep product and material information current, certain gemstones, components, or options may occasionally become unavailable.

If this affects an order you have already placed, our team will contact you to discuss the available options, which may include a comparable alternative, an adjusted production timeline, or cancellation and refund where appropriate.

Noirva reserves the right to modify or discontinue products, materials, specifications, or design options at any time.

Estimated Production & Delivery

Because Noirva pieces are made to order, production and delivery times are estimates based on the selected design, materials, customization, production requirements, and shipping destination.

We make every reasonable effort to complete and dispatch orders within the estimated timeframe provided at the time of purchase.

Unexpected production circumstances, carrier delays, customs processing, severe weather, periods of unusually high demand, or other events outside our reasonable control may affect delivery timing.

If we anticipate a material delay to your order, we will make reasonable efforts to contact you and provide the available options.

Estimated arrival dates are provided for guidance and should not be considered guaranteed delivery dates.

Returns & Restocking Fees

Eligible items may be returned within 30 days of delivery.

Returned pieces must be unworn, unused, undamaged, and returned with their original packaging and accompanying materials.

Because Noirva pieces are made specifically for each order, eligible returns for non-quality-related reasons are subject to a 35% restocking fee, deducted from the refund. Original shipping charges are non-refundable unless otherwise required by applicable law.

Custom-designed or personalized pieces are not eligible for return unless they arrive defective, damaged, or materially different from the confirmed order specifications.

To request a return, please contact Noirva Customer Care before sending the item back. Returns sent without prior authorization may not be accepted or may experience processing delays.

Order Modifications & Cancellations

If you need to change or cancel an order, please contact us as soon as possible after placing it.

Because production may begin shortly after an order is confirmed, modifications or cancellations may no longer be possible once materials have been allocated or production has begun.

Orders that have already been shipped cannot be canceled and will instead be handled in accordance with our Return & Refund Policy, where eligible.

Fraud Prevention & Account Access

To protect our customers and our business, Noirva reserves the right to review, hold, decline, or cancel an order when we reasonably suspect fraudulent, unauthorized, abusive, or otherwise high-risk activity.

In certain circumstances, we may request additional information to verify an order before production or shipment.

We may also suspend or restrict access to the Site or an account where we reasonably believe there has been misuse of the Site, fraudulent activity, violation of these Terms, or unlawful conduct.

Where appropriate, suspected unlawful activity may be reported to the relevant authorities.

Promotions & Coupon Codes

Promotions, discounts, and coupon codes issued by Noirva are subject to the conditions communicated at the time they are offered, including any eligibility requirements, exclusions, expiration dates, or minimum purchase requirements.

Unless expressly stated otherwise, promotional offers and discount codes may not be combined.

Codes published by third-party websites are not controlled by Noirva and are not guaranteed to be valid or current.

Noirva reserves the right to correct, suspend, or withdraw a promotion where an error, misuse, technical issue, or other exceptional circumstance has occurred.

Pricing & Product Information

We make reasonable efforts to ensure that product descriptions, specifications, pricing, imagery, and availability information displayed on noirva.com are accurate.

Occasionally, typographical, technical, pricing, or system errors may occur. Noirva reserves the right to correct such errors when identified.

If a material pricing or product-information error affects an order before fulfillment, we will contact you with the corrected information and the available options, which may include confirming the revised order or canceling it for a refund.

Product photographs are intended to represent each design as accurately as reasonably possible. However, appearance may vary slightly depending on lighting, photography, screen settings, gemstone characteristics, and the natural or handmade variations of individual pieces.

Where applicable, gemstone carat weights may vary by approximately ±0.1 ct, and measurements may vary by approximately ±0.1 mm.

Any reference, comparison, or promotional pricing displayed on the Site should be interpreted according to the specific context and terms presented with that offer.

User Submissions

You may choose to submit reviews, photographs, feedback, questions, suggestions, or other content to Noirva.

By voluntarily submitting content for publication, display, marketing, or promotional use, you grant Noirva a worldwide, royalty-free license to use, reproduce, adapt, publish, display, and distribute that content in connection with Noirva and its products, services, marketing, and digital channels.

You represent that:

• You own or have permission to use the content you submit.

• Your submission is truthful and does not knowingly infringe the rights of another person or entity.

• Your submission does not contain malicious software, unlawful material, or harmful content.

Noirva reserves the right to moderate or remove submitted content where appropriate.

This section does not override our Privacy Policy and does not automatically apply to confidential custom-design materials shared with us as part of a private design consultation.

Custom Design Usage

Custom design is a collaborative process, and different projects may involve customer-provided references, original artwork, Noirva-created design elements, or a combination of these.

Unless otherwise agreed in writing, Noirva may continue to use design techniques, concepts, structural elements, or original design work developed by Noirva during the custom process in future creations.

Customer-provided original artwork or other materials remain subject to the intellectual property rights applicable to those materials.

If you would like a custom design created through Noirva to remain exclusive, please notify us during the design process. An exclusive design arrangement may be available for $500.

Where exclusivity is purchased, its scope—including the specific design covered, duration of exclusivity, reproduction restrictions, and any intellectual property rights included—will be confirmed separately in writing.

The Site may contain links to websites, platforms, or services operated by third parties.

These links are provided for convenience and do not necessarily constitute endorsement by Noirva. We do not control third-party websites and are not responsible for their content, availability, policies, security, accuracy, or practices.

Your use of third-party websites or services is subject to their own terms and policies.

Jewelry Care, Damage & Liability

Fine jewelry requires appropriate care.

Damage resulting from accidental impact, collision, friction, improper handling, misuse, unauthorized alteration or repair, or exposure to conditions inconsistent with our care recommendations may not qualify as a product defect and may fall outside our return or warranty coverage.

This includes damage associated with activities such as bathing, swimming, spa or hot-tub use, or exposure to chemicals where those conditions may adversely affect the jewelry or its finish.

Shipping Information

Customers are responsible for providing a complete and accurate shipping address when placing an order.

If a shipment is delayed, returned, misdelivered, or lost solely because incorrect or incomplete shipping information was provided at checkout, additional shipping, recovery, or replacement costs may apply.

Where reasonably possible, Noirva will assist in working with the carrier to locate or recover the shipment.

Nothing in these Terms and Conditions is intended to limit any consumer rights that cannot legally be waived under applicable law.
